A gift loan is any below-market loan where the forgone interest is in the nature of a gift. $100 of interest was credited on your frozen deposit during the year. If the distribution is not considered community property and you and your spouse file separate returns, each of you must report your separate taxable distributions. This applies to any item due to a listed transaction or other reportable transaction with a significant purpose of avoiding or evading federal income tax. Amortization Calculations:

You must keep detailed records to distinguish those securities or commodities. The securities or commodities held for investment must be identified as such in your records on the day you acquired them (for example, by holding them in a separate brokerage account) specifically identified under section 475. You do not have to file Form 8949 or Schedule D (Form 1040) if you have no capital losses and your only capital gains are capital gain distributions from box 2a of Form(s) 1099-DIV. If any Form 1099-DIV you receive has an amount in box 2b (unrecaptured section 1250 gain), box 2c (section 1202 gain), or box 2d (collectibles (28%) gain), you do not qualify for this exception. To find the amount of interest and carrying charges that is not deductible and that must be added to the annual account net gain or loss, apply the rules described earlier to the positions held in the mixed straddle account.
